Frequently Asked Questions:
What should I do if the police stop me on the street?
You are not required to answer any questions. You can calmly say, “I don’t want to talk to you,” and walk away.
If you’re unsure about walking away, ask, “Am I free to go?” If the officer says yes, walk—don’t run.
If the officer says you are not free to leave, you are being detained. Detention is not the same as an arrest, but it could lead to one. Even if detained or arrested, you are not required to answer questions.
You must provide your name. And yes—what they say on TV is true: “Anything you say can and will be used against you.”
Officers may pat down the outside of your clothing only if they reasonably suspect you’re armed and dangerous. If they try to search beyond a pat-down, state clearly: “I do not consent to a search.”
What should I do if the police stop me in my car?
Always keep your hands visible to the police.
If requested, you must show your driver’s license, registration, and proof of insurance. Have them ready before the officer approaches your window.
If it’s dark, turn on your interior light.
Officers may not search your vehicle without your permission unless they have “probable cause.”
What do I do if I am arrested?
You have the constitutional right to remain silent. Provide your name, but do not answer any other questions, regardless of what the police say.
You also have the right to an attorney. Request one immediately. Once you ask, officers cannot continue questioning you without your lawyer present.
Be aware: police can and will monitor phone calls and jail visits with anyone except your attorney.
